Wage and Hour Disputes

The Department of Labor’s Wage and Hour division enforces compliance with the Fair Labor Standards Act, including laws regarding overtime pay, minimum wage, and child labor, as well as the Family and Medical Leave Act (FMLA). State laws, including the North Carolina Wage and Hour Act also grant employees protection and set additional requirements employers must meet.

While most non-salaried workers are aware they should be paid time and a half for hours worked in excess of 40 per week, there are times when salaried employees should also be paid overtime.
